Terms of Sale
These Terms of Sale ("Agreement") shall govern the sale of products ("Products") by Splitting Colours Jewellery ("Seller", or "we") to the purchaser ("Buyer" or "you") named on the order confirmation ("Order Confirmation"). This Agreement constitutes the entire agreement between the parties concerning the sale of the Products and supersedes all prior or contemporaneous agreements or understandings, written or oral, concerning the same subject matter.
ORDERS
Buyer may place orders for Products through the Seller's website or by contacting Seller's through other communication channels. All orders are subject to acceptance by Seller, and Seller may refuse to accept any order, in its sole discretion.
PRODUCTS
While the Seller's strives to ensure images posted on this website are produced as accurate as possible, please understand that the size and colour of the Products featured on this website may differ from the actual product. Accordingly, the products featured on this website are simply representative of the Seller's collections.
NO RETURNS OR EXCHANGES
All items sold are non-refundable and non-exchangeable.
ORIGINALLY DEFECTIVE ITEMS
In the unlikely event that the Buyer receives a product that seems to have defects caused by Splitting Colours Jewellery, please contact the Seller at info@splittingcolours.com immediately, and in any event no later than 48 hours upon completion of delivery. Please provide photos of the specific products for the Seller to make an initial assessment of the condition of such allegedly defective item.
Seller shall endeavour to repair faulty items or offer a replacement. In the rare situation where repair/replacement is not possible, the Seller shall refund the Buyer's order in full.
Note: Fissures and inclusions are very common in natural gemstones like tourmalines, and are not considered original defects caused by Splitting Colours Jewellery.
SIZING
For rings, the Buyer should ensure that he/she is certain about the correct ring size required as he/she places an order.
Most of the Seller's rings can be resized to order. A service charge of US$100 (equivalent of HK$780) will be levied for every size alternation of any rings purchased from the Seller after delivery. This applies solely on alternation works and excludes shipping costs. If the Buyer requires a size that is not on the list, then please contact the Seller at info@splittingcolours.com.
For all other items, such as bracelets and necklaces, given that these are generally made to the Seller's standard lengths to comply with its aesthetic control, length adjustments are not advisable.
PRICES, TAXES AND SHIPPING CHARGES
All prices stated on the website or quoted by Splitting Colours Jewellery are denominated in Hong Kong Dollars.
Splitting Colours Jewellery reserves the right to modify prices and shipping charges at any time without prior notice. The price of an item and shipping charges displayed on the Website or quoted by our team, at the time we provide you with an order confirmation, will be honoured by Splitting Colours Jewellery. Otherwise, in the case of any unexpected change in price, you will be informed and asked if you wish to reconsider your order before proceeding.
GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. The parties hereby irrevocably submit to the jurisdiction of the courts of Hong Kong for the resolution of any disputes arising out of this Agreement.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings or agreements, whether written or oral, regarding the sale of the Products. This Agreement may not be amended or modified except in writing signed by both parties.
By placing an order for Products, Buyer agrees to be bound by the terms and conditions of this Agreement.
